Fire Legislation

The Fire ( Scotland ) Act 2005 became law in October 2006 affecting all non-domestic premises in Scotland , if you are:

  • Responsible for business premises
  • An employer
  • Self-employed with business premises
  • A charity or voluntary organisation

The new Act supersedes all previous fire legislation including fire certificates. The main emphasises is placing the management of fire safety ie greater control on prevention.

Fire ( Scotland ) Act 2005 states:

“The responsible person must make a suitable and sufficient assessment of the risks to which relevant persons are exposed for the purpose of identifying the general fire precautions he needs to take to comply with the requirements and prohibitions imposed on him by or under this Order.”

Although best practice states that it would be better if the Competent Person is an employee, this legislation recognises the fact that many small and medium sized businesses do not have the resources in time or money to have an employee committed full time to this work, and therefore allows for the appointment of third party assistance to complete the Fire Risk Assessment.

The Fire risk assessment will make reference to and check the following

  • The fire can be detected in reasonable time and that people can be warned
  • There are adequate escape routes for staff, patients, visitors etc to leave the building safety
  • Provide reasonable fire fighting equipment
  • Check those in the building know what to do if there is a fire
  • Check and maintain fire safety equipment.
