Management of Occupational Road Risk
It is common knowledge that roads are a dangerous place and those in roles that require a lot of driving will know this better than most.
Health and Safety legislation means that employers have a clear responsibility to ensure the safety of business drivers. Despite tougher enforcement of existing health and safety at work legislation and new laws, such as the ban on the use of hand-held mobile phones while driving, numerous companies who supply company vehicles have not reviewed their occupational road safety procedures to reflect best practice, despite the rapidly changing at work driving legislation.
In the event of a serious or fatal road traffic accident involving a company employee driving on business, police investigations will focus on numerous issues including the demands placed on the employee by management, vehicle maintenance levels and the reasons for the journey being made. The identification of serious failures that may have contributed to the incident will also be considered.
Remember the ownership of the vehicle doesn’t absolve the employer of any responsibility when it is driven on company business.
